Workers' Compensation FAQ

  1. Do I have to complete the Report of Accident/Illness and Workers’ Compensation Claim Form DWC-1?
    A:
    Yes, you must complete the Report of Accident/Illness form, however, if you do not wish to go to the Occupational Medicine Center or Emergency Department, you can mark the “treatment refused” box. You must also complete the Workers’ Compensation Claim Form DWC1 if you want to make sure you qualify for all benefits. If you do not file the claim form within a year of your injury you may not be able to get benefits.

  2. What happens to my salary if the doctor takes me "off-work"?
    A:
    If you can’t work while you are recovering from a job injury or illness, you will receive Temporary Disability Payments. These payments may change or stop when your doctor says you are able to return to work.

  3. How much will my Temporary Disability payment be?
    A:
    Temporary Disability payments are two-thirds (2/3) of your average weekly pay, within minimums and maximums set by state law. As the regulations governing the minimums and maximums are ever changing, we cannot post them. You can also supplement these benefits with your available Paid Leave and Sick Leave.

  4. Are Temporary disability payments considered taxable income?
    A:
    No, these benefits are tax-free.

  5. What happens if the doctor gives me temporary work restrictions that prevent me from performing my regular work?
    A:
    You and your supervisor will determine if the restrictions can be accommodated in your home department. If not, you would be eligible for the Temporary Work Assignment (TWA) Program. The temporary work assignment would be provided within the same entity (LLUMC, LLU, LLUHC, LLUBMC or LLUCH) as your home department and the assignment would be within your work restrictions. While participating in a temporary work assignment you would continue to receive your regular salary as you receive medical treatment and recover from their injury. As in your home department, your performance will be evaluated. Your TWA supervisor will complete a performance appraisal at the end of your assignment, which will be forwarded to your home department supervisor and placed in your personnel file.
