Amend PHI

A patient has the right to request that we amend PHI or a record about him/her in a designated record set. If a patient requests an amendment to his/her record, the covered entity must act upon the request timely in accordance with the requirements of the Privacy Rule at 45 C.F.R. §164.526. All patient requests for amendment to a record must be forwarded to the Health Information Management (HIM) Department.

The HIM Department will determine based on the requirements of the Rule whether to accept or deny the request for amendment. If the HIM Department accepts the request for amendment, they must make reasonable efforts to inform and provide the amendment within a reasonable time frame to:

  • The persons identified by the individual as having received the PHI and needing the amendment.
  • Business associates that may have PHI that is the subject of the amendment and that, if not informed, may be to the detriment of the patient.

The HIM Department can deny the request for amendment, if it is determined that the PHI or record:

  • Is not part of the designated record set
  • Would not be available for inspection based on conditions specified by the Rule
  • Is accurate and complete

If you are informed by another covered entity that an individual's PHI has been amended, you must forward the information to the HIM Department for an amendment of the PHI contained in the designated record set.
