Accounting of Disclosures
Patients have a right to receive an Accounting of Disclosures which is a listing or report of certain disclosures a healthcare provider made about them.
Regulations require that healthcare providers track certain disclosures of protected health information (PHI) to provide an Accounting of Disclosures to the patient upon request. Generally, when a disclosure is made for purposes other than treatment, payment and health care operations (TPO) without patient authorization or for certain disclosures required or permitted under the Rule, the patient has a right to know of such disclosure and we must track for an accounting. For example, we are permitted under the Rule to continue routine disclosures to public agencies (e.g., cancer registries, vital statistics). We must track the disclosure so that we can inform the patients of who received their PHI. The list or report of disclosures generated for the patient is called an Accounting of Disclosures.
What information is included in the Accounting of Disclosures report provided to patients at their request?
The information contained in an Accounting of Disclosures report is limited to:
- Name of the patient
- Medical Record Number
- Date of the disclosure
- LLUH entity making the disclosure
- Purpose of the disclosure
- Description of information disclosed
- Name of the organization or person receiving the information (recipient)
- Address and phone number of the recipient
